1. Acceptance of Terms

By downloading, installing, or using MediMinder ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

MediMinder is a medication reminder and tracking application designed to help users manage their medication schedules. The App provides:

• Medication scheduling and reminders
• Dose tracking and adherence history
• Drug interaction warnings
• Side effect tracking and reporting
• Caregiver sharing and notifications
• Emergency medical card generation
• Refill tracking and pharmacy finder
• Multi-profile management for families
• Achievements and gamification features
• Cross-device sync via iCloud
• Widgets, complications, and Live Activities
• Apple Watch, iPad, Mac, and Vision Pro apps

3. Medical Disclaimer

IMPORTANT: MediMinder is NOT a medical device and is NOT intended to diagnose, treat, cure, or prevent any disease or health condition.

• The App is a reminder and tracking tool only and does not provide medical advice
• Drug interaction warnings are informational only and may not be complete
• Always follow your healthcare provider's instructions regarding medications
• Do not rely solely on the App for medication management
• Consult your doctor or pharmacist for medical questions
• In case of a medical emergency, contact emergency services immediately
• The drug interaction database may not include all possible interactions

We are not responsible for any health outcomes resulting from the use or misuse of this App, including reliance on drug interaction warnings or reminder failures.

4. User Responsibilities

You are responsible for:

• Entering accurate medication information
• Verifying reminder times and dosages
• Confirming drug interaction warnings with a healthcare provider
• Maintaining the security of your device
• Ensuring notifications are properly configured on your device
• Using the App in compliance with all applicable laws
• Managing caregiver access appropriately
• Keeping your emergency medical card information current

5. Account and Data

MediMinder does not require an account. Your data is stored locally on your device and optionally synced through your personal iCloud account.

You are responsible for:

• Backing up your data
• Managing your iCloud storage
• The security of your Apple ID
• Managing caregiver access permissions

6. Caregiver Sharing

When using caregiver sharing features:

• You consent to sharing your medication data with invited caregivers
• You are responsible for managing who has access
• Caregivers may receive notifications about missed doses
• You can revoke caregiver access at any time
• We are not responsible for how caregivers use the shared information

7. Subscriptions and Payments

7.1 Free Trial

New users are eligible for a 7-day free trial that includes all app features. The trial allows you to experience the full functionality of MediMinder before committing to a subscription.

• The trial begins when you first launch the app
• All features are unlocked during the trial period
• No payment is required to start the trial
• If you don't subscribe before the trial ends, access to the app will be restricted until you subscribe

7.2 Subscription Options

After the trial period, continued access requires one of the following subscription options:

• Monthly: $2.99/month - Auto-renewing subscription
• Annual: $19.99/year (save 44%) - Auto-renewing subscription
• Lifetime: $49.99 one-time purchase - Never expires, no recurring charges

7.3 What's Included

• Caregiver sharing

• Side effect tracking

7.4 Payment Terms

• Payment is processed through Apple's App Store
• Monthly and annual subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• The Lifetime option is a one-time purchase that does not renew
• Cancel anytime through your Apple ID subscription settings
• No refunds for partial subscription periods (subject to Apple's refund policies)

7.5 Restore Purchases

If you've previously purchased a subscription or lifetime access, you can restore your purchase by tapping "Restore Purchases" in the app settings or on the subscription screen.

7.6 Price Changes

We reserve the right to change subscription prices. Existing subscribers will be notified of any price changes before their next renewal and can cancel if they do not agree. Lifetime purchases are not affected by price changes.

8. Intellectual Property

MediMinder and its contents, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or distribute the App
• Reverse engineer or decompile the App
• Remove any copyright or proprietary notices
• Use the App for any commercial purpose without permission
• Extract or reuse the drug interaction database

9. User Content

You retain ownership of any data you enter into the App, including:

• Medication information
• Profile data
• Side effect logs
• Notes and custom instructions

Since this data is stored only on your devices, we do not access, use, or claim any rights to it.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The App is provided "as is" without warranties of any kind, express or implied
• We do not warrant that the App will be uninterrupted, error-free, or completely secure
• We do not warrant the accuracy or completeness of drug interaction data
• We are not liable for missed reminders due to device settings, system updates, or technical issues
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount paid for the App in the 12 months preceding any claim

11. Indemnification

You agree to indemnify and hold harmless MediMinder, its developers, and affiliates from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Any claim that your use of the App caused damage to a third party

12. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe:

• Violates these Terms
• Is harmful to other users
• Is illegal or fraudulent
• Could expose us to liability

You may stop using the App at any time by deleting it from your devices.

13. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes through:

• An in-app notice
• Updated date on this page

Continued use of the App after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of Australia. Any disputes shall be resolved in the courts of Australia.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MediMinder regarding the App and supersede any prior agreements.
